Of Creation Of The

KIVU NATIONAL BANK

For the Carrying on and Managing of a Public Bank and act as the Monetary Authority of KIVU

Now know ye, That we being desirous to promote the public Good and Benefit of our People, which in these Presents are chiefly designed and intended, as well as the Profit and Advantage of all such as have subscribed and contributed according to the present Act, and our Commission thereupon issued, their lawful Successors, and Assignees respectively, and in pursuance as well of the Powers and Clauses for this Purpose, contained in the present Act, as of our Promise and Declaration, made in or by our said Commission, or Letters Patents, under the Great Seal of Kivu, whereby the Subscriptions and Contributions on the present Act have been promoted or encouraged, and by Virtue of our Prerogative Presidential, certain Knowledge, and meer Motion, Have given, granted, made, ordained, constituted, declared, appointed, and established, and by these Presents, for Us, our lawful Successors, do give, grant, make, ordain, constitute, declare, appoint and establish, that the said Ma-N’Govo N’Goyo and all and every other Person and Persons, Natives and Foreigners, Bodies Politick or Corporate, who, over and above the Person (s) before especially named, have at any Time or Times before the making of these Presents, subscribed and contributed any Sum or Sums of Money towards the General Treasury of the Kivu National Bank; and them by that Name, one Body Politick and Corporate, in Deed and in Name, We do, for Us, and our lawful Successors, make, create, erect, establish, and confirm for ever, by these Presents, and by the same Name, they and their Successors shall have perpetual Succession, and shall and may have and use a Common Seal, for the Use, Business, or Affairs of the said Body Politick and Corporate, and their Successors, with Power to break, alter, and to make anew their Seal from Time to Time, at their Pleasure, and as they shall see Cause.

Whereas the Nation of Kivu being partially occupied by a despot organization called DRC provenience from a chaotic mess and paramount wrong done to us and our neighbours by the so called Berlin Conference of 1884-85.

Whereas the end of such chaotic mess and occupation of Kivu by this unnatural organization of the DRC being an historic inevitability it is Decreed that the Kivu National Bank be created to provide funds for the sustainable welfare and future of the Nation and Country of Kivu.

Whereas the Government of Kivu Controls more than 95% of the Territorial Surface of the Country and Nation of Kivu and that all the Mineral (Cobalt, Copper, Cadmium, Petroleum, Gold, Silver, Zinc, Manganese, Tin, Germanium, Bauxite, Iron ore, Coal, Hydropower, Timber, Natural Gas, etc…) and Goods (Precious Wood, Palm Oil, etc…) Wealth shall be, and be called, accepted, esteemed, reputed and taken as The Guarantee Capital and Principal Stock of the Corporation hereby constituted, and any other foreign moneys (coins and notes) shall be, and be called Common Capital and extra Stock of the Corporation.

Whereas the Kivu National Bank being the Monetary Authority of Kivu is Authorized to issue all necessary coins and notes for the use of the people and all public and private corporations.

Whereas the Commission in charge of establishing the Kivu National Bank shall issue the Constitution, Regulation and Financial Arrangements including the Monetary Policy of the Kivu National Bank.

Whereas the said Constitution and Regulations shall allow for the future creation of the Kivu Financial Services Authority.

Whereas we do hereby, declare, direct and appoint, that the Kivu National Bank shall also be allowed to issue Treasury Bonds on behalf of the Government of Kivu.

Whereas all Officers of the Kivu National Bank must before taking the privilege of Office swear/affirm an OATH OR SOLEMN AFFIRMATION OF OFFICE as such:

I, ..............., do solemnly swear (or affirm) that I will faithfully and to the best of my judgment and ability perform the duties that relate to any office or position in the Bank held by me. I also solemnly swear (or affirm) that I will not communicate or allow to be communicated, to any person not entitled to it, any confidential information that relates to the business or affairs of the Bank that I may learn in the course of performing those duties; use any such information for any purpose other than to perform those duties; or allow any person to inspect or have access to any books and records that belong to or that are in the possession of the Bank and that relate to the business or affairs of the Bank, unless the person is legally entitled to inspect them or to have access to them.

KPA‡

The Kivu Currency Act of 2007

I, Ma-N’Govo N’Goyo, Governor of the Kivu National Bank, declare that in order for the Kivu National Bank to fully and properly function as the Central Bank of the Kivu Nation with its purpose of serving the Kivu Citizens, give notice that after consultation with the Governing Court of Directors, The Privy Council of the Kivu National Bank, and with the approval of His Excellency The President of the United Republic of Kivu Elie-Desire Alawale, have hereby have decide that:

I. The need for a National Currency for the People, Nation, State, Territory and Country of Kivu is indicated.

II. That the Kivu Currency shall be in electronic, paper and coinage form and in suitable denominations called the Kivu Panda ‡ (currency code KPA and 358) is the unit of currency of the United Republic of Kivu. It is normally abbreviated to the Kivu Panda sign ‡, or alternatively KPA‡.The Kivu Panda is divided into 100 (equal) cents.

III. Whereas quantities for paper bills of credit (Kivu Pandas) are needed to be created and issued in the Nation and territories of the Republic of Kivu, by virtue of acts, orders, resolutions, or votes of assembly, such bills of credit are henceforward to be legal tender in payment of money.

IV. That from and after the 5th day of June 2007, no act, order, resolution, or vote of assembly, in the Nation and territories of the United Republic of Kivu, shall be made, for creating or issuing any other type of paper bills, or bills of credit of any kind or denomination whatsoever. Such paper bills, scrips or bills of credit shall not be legal tender in payment of any bargains, contracts, debts, dues, or demands whatsoever; and every clause or provision which shall hereafter be inserted in any act, order, resolution, or vote of assembly, contrary to this act, shall be null and void.

V. And whereas great quantities of paper bills, or bills of credit, from DRC which are now actually in circulation and currency in the Nation and territories of the United Republic of Kivu, emitted in pursuance of acts of occupation; we declare such bills shall be removed from circulation as expediently as possible but without hardship to the Citizens of Kivu. Temporary coexistence of Kivun and DRC currencies shall be tolerated only as long as necessary to secure the Liberation of Kivu.

VI. And be it further enacted by the authority aforesaid, That if any government official, in the Nation and territories of the United Republic of Kivu, shall, from and after the said 5th day of June 2007, gives his assent to any act or order of assembly contrary to the true intent and meaning of this act, such act shall be a nullity.

VII. The Kivun Panda ‡ (KPA) shall initially be valued on par with the Euro (EUR) and shall float against this benchmark after issuance.

VIII. This Act may be supplemented by such as other laws promulgated by the National Bank as necessary to implement it.
